JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-07-2019 The petitioner is an Ayush (Unani) doctor engaged under the Rashtriya Bal Swasthya Karyakram in the district of Jamui. Her husband is also Ayush(Unani) doctor working under the same scheme but in a different district viz. East Champaran at Motihari. The petitioner was not given the posting at a place where her husband was posted, despite her entitlement in terms of the government circular directing that as far as practicable,
Patna High Court CWJC No.14951 of 2019(2) dt.29-07-2019 2/3 husband and wife be posted at one place in case of vacancy. Nonetheless, now the petitioner is in familyway and her mother-in-law has recently suffered a paralytic attack.
Under the aforesaid circumstances, a request has persistently been made before the Executive Director, State Health Society, Bihar, Patna for transferring the petitioner at the place where her husband is posted. The last of such representation is dated 03.06.2019.
The grievance of the petitioner as of now is that such representations have never been adverted to and no decision has been taken as yet on such request of the petitioner.
The learned advocate for the respondent State Health Society, Bihar Patna submits that the last of the representation of the petitioner is in the process of being decided and a decision shall be taken within a period of four weeks of the passing of this order.
Patna High Court CWJC No.14951 of 2019(2) dt.29-07-2019 3/3 Let a decision on the representation of the petitioner be taken in accordance with law and expeditiously preferably within the aforesaid period. With the aforesaid observation/direction, the writ petition stands disposed off.
