The petitioner is apprehending his arrest in connection with Tr. No.1560/18 arising out of Complaint Case No.35 of 2018 registered for offences punishable under Sections 498(A), 307, 323, 329 of the Indian Penal Code and Section 3⁄4 of D.P.Act.

Petitioner happens to be husband of the complainant and there is allegation of demand of dowry and torture against him. It further appears form order dated 26.09.2019 that the contention has been made by O.P.no.2 that a compromise has been reached between the parties and the father of the petitioner had issued a cheque of Rs.50,000/- towards refund of the value of the gifts, which was received by him and he had promised to

No.46238 of 2019(4) dt.22-10-2019 2/2 pay back the amount in cash but the amount was not paid and the learned counsel for the petitioner was directed to seek instruction in this regard but submission of the learned counsel for the petitioner is that he has no instruction in this regard. No body appears on behalf of O.P.no.2.

Having heard both sides and in view of the facts and circumstances, as stated above, it appears that parties have no interest in this case.

As such this application is dismissed.
