The petitioners apprehend their arrest in Minapur P.S. Case No. 310 of 2019, registered for the offences punishable under Sections 341, 323, 324, 307, 379 and 34 of the Indian Penal Code. Later on section 302 IPC was added. Prosecution case in brief is that on 12.06.2019 at 1.00 pm Vijay Rai, entered into the house of informant and tried to outrage the modesty of the sister-in-law of the informant. On 13.06.2019 Akhilesh Rai went to complain to Vijay Rai about the incident then all the 14 accused persons including petitioners having armed with weapons surrounded the informant and assaulted the informant and his family members. Petitioner no. 1
Patna High Court CR. MISC. No.59617 of 2021(2) dt.05-07-2022 2/2 is alleged to have assaulted father of petitioner no. 1. Petitioner no. 2 is alleged to have snatched jewellery. Case and counter case for the same occurrence. Specific allegation of assault is against co-accused Ranjeet Rai who is alleged to have assaulted on the head of Akhilesh Rai (deceased) causing grievous injury. There is no injury report of father of informant on the record. Petitioners are own Gotias of informant. Similarly situated coaccused have been granted bail by this Court vide order dated 17.06.2020 passed in Cr. Misc. No. 82464 of 2019.
Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No. 310 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
