The petitioner apprehends his arrest in a case registered for the offence under Section 366A/34 of the Indian Penal Code.
As per F.I.R., it is alleged that co-accused Ankit Kumar with the help of petitioner and other co-accused persons kidnapped the niece of informant.
It is submitted on behalf of petitioner that specific accusation of kidnapping is against c-accused Ankit Kumar. Petitioner has been made accused in this case only because he happens to be agnates of co-accused Ankit Kumar. In the statement recorded under Section 164 Cr.P.C., the victim has not alleged any sexual misconduct against this petitioner. Petitioner has got clean antecedent.
Patna High Court CR. MISC. No.49188 of 2022(2) dt.15-12-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Bachhwara P.S. Case No. 104 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
