JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 20.08.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State and also heard learned counsel for the informant.

Three persons sustained injuries in the alleged occurrence and admittedly, two persons sustained simple injury whereas injuredBirendra Kumar is said to have sustained grievous injury and got admitted in private hospital, Patna.

The impugned order reveals that CT Scan of the aforesaid injured reflects that fracture was found on bilateral front parietal region of scalp.

Learned counsel for the petitioner submits that there is case and counter case between the parties and moreover in course of investigation when statement of injured-Birendra Kumar was recorded the said injured, specifically, stated that it were Raj Kumar Sah and Shiv Kumar Sah who assaulted him with lathi. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl.
