In this case, the petitioner is seeking anticipatory bail in connection with Haspura P.S. Case No.79 of 2018, registered for the offence under Sections 395 and 397 of the Indian Penal Code and under Section 4/5 of the Explosive Substance Act.

Allegation has been made that accused persons have looted a shop and took away ornaments and cash. The name of the petitioner has transpired during the course of investigation.

Looking to the nature of allegation as also the fact that the petitioner is an accused of identical nature of case, this

Patna High Court CR. MISC. No.45875 of 2019(2) dt.24-07-2019 2/2 Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court.
