JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 11-08-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376, 504 and 506/34 of the Indian Penal Code.

It is a case of committing rape with the informant's daughter by the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that as a matter of fact and the reason of false implication of this petitioner in the present case is that the informant and the petitioner are co-villagers and the victim and the petitioner were in love affairs since last three years and both wants to marry with each other and the victim always express

No.59614 of 2021(3) dt.11-08-2022 2/2 her desire before her parents to marry with the petitioner but the parents of the victim was not ready to marry her with the petitioner because there is some inimical terms between the informant and the father of the petitioner and the informant forcibly married his daughter without her consent. From perusal of the FIR, the victim is aged about 19 years. Petitioner has clean antecedent.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Ms. Arti Kumari, Judicial Magistrate, Ist Class, Muzaffarpur in connection with Katra P.S. Case No. 139 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
