The petitioner seeks bail in a case registered for offences punishable under Sections 147, 148, 149, 323, 324, 341, 342, 307, 504, 506 and 302 of the Indian Penal Code.
It is contended that allegation is against seven persons including the petitioner who had caught hold and assaulted the informant and his brothers Bhim Mahaldar and Shatrughan Mahaldar. However, there is specific allegation against Dharmendra Mahaldar who had assaulted upon the head of the informant by 'Khanti' and Bhim Mahaldar was assaulted by Ram Kumar Mahaldar and Hira Mahaldar by 'Khanti' due to which he received injury and later on he died during course of
Patna High Court Cr.Misc. No.34545 of 2015 (3) dt.16-10-2015 2/2 treatment.
It is contended that there is no specific allegation against the petitioner of assaulting any body causing injury. Having regards to the facts and circumstances of the case, the petitioner, namely, Kanhaiya Mahaldar is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in Korha P.S. Case No. 79/2015.
