In this case the petitioner is claiming that he was allotted work order for up-gradation Sub Divisional Hospital at Jhanjharpur, entered into an agreement being Agreement No. 23/F 2 of 2006-2007 and, accordingly, the work order was given to the petitioner but, as
Patna High Court CWJC No.11364 of 2016 dt.21-02-2017 there was an agreement for mosaiking the floor of the hospital, on the statement of the Engineer, at site, in place of mosaic, he has marbled the floor of the hospital. He fairly submits that there was no agreement for marbling the floor but, at the instance of the Engineer, at the spot, he has done the job.
Let the petitioner file an appropriate application before the Engineer-in-chief, Department of Building Construction, Government of Bihar, Patna who will consider the case of the petitioner and will pass order in accordance with law.
For convenience, the petitioner is directed to file a representation along with a copy of this order and, if the same is filed, the Engineer-in-Chief will dispose of the same within a period of three months from the date of filing of the representation. With the aforementioned observation and direction, this application is disposed of.
