ANJANA MISHRA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioners and learned A.P.P. appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with Biddupur P.S. Case No.111 of 2016 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 307 and 379 of the Indian Penal Code.

Learned counsel for the petitioners submits that though there is allegation of the informant that each petitioner attacked over Sheo Sharan Kumar, Krishna Kumar and Ajay Rai causing severe injuries but the injuries attributed to these petitioners have been found to be simple in nature. It is further submitted that though the occurrence is said to be of 26.04.2016 but the F.I.R.

Patna High Court Cr.Misc. No.27610 of 2016 (2) dt.20-08-2016 has been lodged on 28.04.2016, for which no plausible explanation has been offered by the informant. Considering the nature of allegation made and the injuries sustained by the parties as also the fact that the petitioners have got clean antecedents, let the petitioners, in the event of their arrest or surrender in the court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Biddupur P.S. Case No.111 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Anjana Mishra, J) V.P.Sinha/- U
