The petitioner seeks bail in connection with Excise Case no. 371 of 2017 registered under Section 30(a) of the Bihar Excise and Prohibition Act 2016.
15.780 country made liquor is said to have been recovered from the house of Binod Sah and petitioner who is said to have been supplier of the said liquor was apprehended. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. He has no concern either with the seized liquor or with the co-accused Binod Sah or with any trade of liquor. He has been falsely implicated in the case by the police
Patna High Court Cr.Misc. No.9058 of 2018(2) dt.17-02-2018 2/2 merely on suspicion while he was passing through the road. He has no criminal antecedent. He has been languishing in custody since 01.01.2018.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Motihari, East Champaran in connection with Excise Case no. 371 of 2017.
