University.

2. The petitioner is the Secretary of Balmiki Singh Degree College, who preferred the present writ petition

2/4 seeking a direction upon the respondent University to send proposal for grant of approval of permanent affiliation from Session 2026-2030 onwards to the State Government in terms with Section 21(2)(d) of the Bihar Universities Act.

It is submitted that, notwithstanding the fact that the Statutory Committee duly constituted by the University inspected the College in question and recommended it for permanent affiliation, the necessary documents and recommendation letters have not been forwarded to the State Government due to which the petitioner's institution has been deprived from permanent affiliation.

4. Referring to Letter Nos. 5220(R) and 5221(R) both dated 05.05.2026, it is submitted that on account of inaction of the respondent University, the State Government could not take a final decision. Had the necessary documents and recommendation letters been forwarded to the State Government, a decision regarding grant of permanent affiliation would have been taken; however the same has not been done, compelling the petitioner to approach this Court. It is submitted that on account of delay, the petitioner's institution has also been deprived from taking admission of the students for Session 2026-2030. It is contended that the name

3/4 of the petitioner's institution has also not been uploaded on Samarth Portal due to which the institution is also facing difficulty in getting the admission of the students in new academic session.

5. Learned Advocates for the University and the State, on the other hand, submit that an adjournment is required to apprise this Court with regard to the present position.

Having considered the limited grievance of the petitioner and upon perusal of Letter Nos. 5220(R) and 5221(R) both dated 05.05.2026, this Court is of the opinion that keeping the matter pending would not serve any useful purpose. Accordingly, the University is directed to forward all necessary documents along with the recommendations of the Statutory Committee to the State respondents within one week in case same has not been sent till date.

7. On receipt of the aforesaid letters and recommendations forwarded by the respondent University, the respondent No. 4, the Director, Department of Higher Education, Government of Bihar, shall consider the same and pass an appropriate order with regard to the grant of permanent affiliation, after considering the inspection report and the

4/4 recommendation letters submitted by the Statutory Committee, if there is no legal impediment otherwise. The concerned respondents shall also pass the consequential order for uploading the name of the petitioner's institution on the Samarth Portal, if the petitioner's claim is found to be in order, within a further period of two weeks.

8. With the aforesaid direction, the present writ petition stands disposed.
