====================================================== CORAM: HONOURABLE MR. JUSTICE S. B. PD. SINGH ORAL ORDER 22-03-2025 Heard learned counsel for the petitioner, learned counsel for complainant and learned APP for the State.
2. The petitioner has filed the instant application for apprehending his arrest in a case registered for the offenses punishable under Sections 498(A), 323, 504/34 of the Indian Penal Code.
3. It is a case of torturing, assaulting and demand of dowry. Petitioner is husband of the victim ie. complainant's daughter.
4. In pursuance to the direction of this Court, to
2/4 appear before the Mediation Centre, both the parties have appeared before the Patna High Court Mediation Centre. The report of Memorandum of Agreement, sent by Patna High Court Mediation Center, dated 28.02.2025, has been received and is kept with the petition. It suggests that both parties have agreed upon to part ways. The petitioner agrees to pay Rs. 3,50,000/- as full and final settlement to the Opposite Party No. 2. Out of which :- (i) On 28.02.2025, petitioner has paid Rs. 1,00,001/- (one lakh one rupees) by way of Demand Draft issued by Bandhan Bank of in favour of O.P. No. 3, as first installment. (ii) As per the memorandum, petitioner has paid Rs. 1,00,000/- (one lakh rupees) on 22.03.2025, by way of Demand Draft issued by Bandhan Bank of in favour of O.P. No. 3, as second installment.
(iii) third installment of Rs.
1,00,000/- (one lakh rupees) will be paid by petitioner to O.P. No. 3 by way of Demand Draft, at the time of furnishing of bail bonds before the learned trial Court (iv) rest amount of Rs. 50,000/- (fifty thousand rupees) (fourth and final installment) shall be paid to Opposite Party
3/4 No. 3 by way of Demand Draft, at the time of decree after joint application of divorce u/s 13(B) of Hindu Marriage Act.
5. Both the parties agreed to file an application before the appropriate Court for mutual consent of divorce.
6. In the meantime, as per their agreement, Both parties have to withdraw their respective cases Civil/Criminal in nature filed against each other.
7. Having heard learned counsel for the parties and considering the above facts as also mentioned in Memorandum of Agreement, this Court is inclined to enlarge the petitioner on bail after verifying the conditions as per the memorandum of agreement of mediation report between the parties. The above named petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Complaint Case No. 1276 of 2022 (Trial No. 190 of 2022), he will be enlarged on bail (subject to fulfillment of the conditions mentioned in the
4/4 said agreement) on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Saran, Chapra.
8. The bail bond of the petitioner will be accepted on showing the receipt of Rs. 1,00,000/- (one lakh rupees) by the petitioner in favour of O.P. No. 3 (Nidhi Kumari).
