JUSTICE MOHIT KUMAR SHAH ORAL ORDER 17-08-2023 The present writ petition has been filed seeking the following relief:- "1.i) For issuance of writ in the nature of certiorari for quashing of the order dated 03.07.2023 passed by the office of Collectorate, Saharsa (District General Branch) issued under the signature of District Arms Magistrate, Saharsa, on recommendation made by the District Magistrate, Begusarai, for Cancellation of the Licensed Arms vide Letter No. 121/Arms dated 13.04.2023 after lodging of First Information Report in connection with Barauni O.P Refinery P.S Case No.137 of 2023

Patna High Court CWJC No.10714 of 2023(2) dt.17-08-2023 2/2 u/s 188 of I.PC.

ii) For issuance of writ in the nature of mandamus directing the respondent to re-issue and release the Arms license of N.P.Bor Rifle Bearing License No. 61/4894 and N.P.Bor Revolver Bearing License No. 47/4880."

After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to challenge the order dated 03.07.2023, passed by the Collector, Saharsa, by filing appropriate appeal before the Appellate Authority. Liberty so sought is granted.

It is needless to state that in case appropriate appeal is filed, within a period of two weeks from today, the Appellate Authority, shall consider the same on merits and pass a reasoned and a speaking order, in accordance with law, within a period of eight weeks, thereafter.

The present writ petition stands disposed off on the aforesaid terms.
