2. The petitioner seeks bail in connection with Jhajha (RPF Post) P.S. Case No. 01 of 2025, instituted for the offences punishable under Section 3(a) of RP (UP) Act and Section 153 of Railway Act.
3. The prosecution case, in short, is that the petitioner was caught red handed with the stolen property of Railway i.e. 12 pieces of pandroll clip and 7 pieces of iron liner of railway.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. No incriminating material has been recovered from the conscious possession of the petitioner. Learned counsel for
Patna High Court CR. MISC. No.51915 of 2025(2) dt.06-08-2025 2/2 the petitioner also submits that the allegation levelled against the petitioner is general and omnibus in nature. It is further submitted that the said articles were recovered in bushes. The petitioner is a sweeeper and he has got no knowledge about these articles. The petitioner is in custody since 09.01.2025 and has got no criminal antecedent.
5. Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
7. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Jhajha (RPF Post) P.S. Case No. 01 of 2025.
