Patna High Court CR. MISC. No.12226 of 2021(4) dt.04-03-2022 2/3 The petitioners seek bail in anticipation of their arrest in connection with Chatapur (Rajeshwari O.P.) P.S. Case No. 180 of 2020, dated 25.07.2020, instituted for the offences under Sections 302 and 201/34 of the Indian Penal Code.

The father of the informant was found dead in a ditch. The informant suspected the hands of the petitioners because of a controversial marriage between a boy belonging to the family of the informant and a girl of the village of the petitioners. It was in this connection that the petitioners are alleged to have threatened the informant of dire consequences in the past.

Only on the aforesaid basis, it has been suspected that the petitioners may have participated in the occurrence of killing the deceased.

It has been submitted on behalf of the petitioners that beyond such wild suspicion, there is no other material to connect them with the offence. The so-called threatening given by the petitioners has also not been confirmed during the course of investigation.

Patna High Court CR. MISC. No.12226 of 2021(4) dt.04-03-2022 3/3 Merely on that account, it has been argued, the petitioners cannot be refused anticipatory bail. It has also been submitted that no concrete material with regard to the complicity of the petitioners could be collected during the course of investigation.

Considering the submissions afore-noted and the background facts, the provisional bail granted to the petitioners vide order dated 17.12.2021 is, hereby, confirmed. They shall remain on the same bail-bonds. The application stands allowed accordingly.
