The petitioner apprehends her arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.

As per F.I.R., all the F.I.R. named accused persons including this petitioner assaulted the father of the informant by fists, slaps, lathi and danda. It is further alleged that co-accused Md. Raja took out cash of Rs. 5000/- and one cell phone from the position of father of the informant.

It is submitted on behalf of petitioner that specific accusation of assault is against other co-accused persons. There is general and omnibus allegation against this petitioner. Petitioner is lady, having clean antecedent, and own mother-inlaw of sister of the informant.

Patna High Court CR. MISC. No.49208 of 2022(2) dt.15-12-2022 2/2 Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection with Beliya Belon P.S. Case No. 41 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
