JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-04-2018 The petitioner no. 1 is stated to have been arrested. His petition has therefore become infructuous. The petitioner no. 2 seeks bail in anticipation of his arrest in connection with Bettiah Muffasil (Manuapul) P.S. Case No. 388 of 2017 dated 14.09.2017 instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 337, 338, 353, 504 and 506 of the Indian Penal Code.

The petitioner no. 2 is said to be member of a mob of about 500-600 people which had congregated on the road with the dead body of one person and had obstructed the traffic. This act of the mob had disturbed the even tempo of life. The mob had also indulged in brick-bats and some of the police personnel were injured in the occurrence.

Under similar circumstances, other accused persons of this case have been granted the privilege of anticipatory bail.

For the reasons aforesaid, the petitioner no. 2 above named is directed to be released in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Muffasil (Manuapul) P.S. Case No. 388 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
