JUSTICE RAJEEV RANJAN PRASAD ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date : 30-07-2018 This Public Interest Litigation has been filed by Sri Amanat Abbas, the petitioner, in his capacity as General Secretary of the Anjuman-E-Sajjadiya. When the matter was taken up by us on 06.03.2018, we had passed a detailed order and we had indicated various factors to be explained by the petitioner. By filing two counter affidavits on 15th of March, 2018 and another on 20th of June, 2018 Sri Amanat Abbas has tried to explain the objections raised by the respondents with regard to
Patna High Court CWJC No.15276 of 2017 dt.30-07-2018 2/2 filing of earlier writ petitions not only by the present petitioner, being C.W.J.C. No. 5821 of 2017, which was dismissed by this Court on 12.02.2018 and various other objections raised, but the moot question which we had posed on 06.03.2018 still remains unanswered. The writ petition has been filed by the petitioner in his capacity as General Secretary of the Society in question. Except for filing of documents of registration of the society and election as the Secretary of the society, nothing has been brought on record by way of a resolution of the society deciding to canvass the issue in the form of a Public Interest Litigation under Article 226 before this Court and subsequently authorizing the petitioner to file the writ petition and canvass the same before this Court. In the absence of there being any authority on behalf of the petitioner, for filing the writ petition, we are not inclined to interfere in the matter.
