JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 28.08.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State and also heard learned counsel for the informant.

Marriage of the petitioner had taken place in the year 2003 and after ten years of the marriage, present case was lodged. Moreover, petitioner has already filed matrimonial suit for restitution of his conjugal rights and furthermore, petitioner is languishing in jail custody since 10.6.2015.

Learned counsel for the informant submits that earlier petitioner had filed anticipatory bail in which he was granted provisional bail by this court directing him to keep the informant with him but the petitioner did not obey the order of this court and refused to keep the informant with him. It is further contended by him that

Patna High Court Cr.Misc. No.34989 of 2015 (2) dt.28-08-2015 taking note of the above stated conduct of the petitioner, anticipatory bail of the petitioner was dismissed and thereafter, petitioner was remanded in this case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in Nalanda (Biharsharif) P.S. Case no. 66/2013.
