The petitioner is apprehending arrest in a case registered for the offences punishable under sections 420 and 386/34 of the Indian Penal Code.

The prosecution case is that the informant went inside the motel of co accused Munna to take meal when Munna asked about his business, in the meantime the petitioner appeared. The petitioner was introduced by co accused Munna to the informant as Officer in-charge of local police station, thereafter the petitioner demanded paper of the vehicle of the informant and stated that the vehicle in question is stolen property and on refusal

Patna High Court Cr.Misc. No.33646 of 2015 (2) dt.13-08-2015 2/2 to hand over the paper, five stoves were demanded whereas two stoves were taken away.

It is submitted by the learned counsel for the petitioner that the petitioner is Recovery Agent of Tata Motors Finance Limited and the police has maliciously roped him in the present case. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Barh P.S. Case No. 77 of 2015 pending in the court of learned ACJM, Barh, Patna. This application is disposed of with the aforesaid observation/direction.
