JUSTICE ARUN KUMAR ORAL ORDER 28-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 12.10.2017, seeks bail in Mahesi PS Case No. 123 of 2011 registered under Section 392 of the IPC.

The allegation in brief is that the petitioner robbed the informant, a truck driver, and relieved him of sixteen thousand rupees.

Learned Counsel for the petitioner submits that there was some dispute relating to paying price of the food, the petitioner is a Dhaba owner so falsely implicated in this case, another co-accused Naresh Ram has been granted bail in the year 2012 itself. Whereas learned Counsel for the State submits that this a case of the year 2011, the petitioner was absconding and apprehended only in the year 2017, he has also criminal antecedents of two cases of robbery and dacoity.

Having considered the said facts and circumstances, the prayer for bail of the petitioner is rejected. Snkumar/- (Arun Kumar, J.) U T
