The petitioner has been in custody since 24.04.2017 in connection with Sadar P.S. Case No. 16/2017 registered for the offences punishable under Section 379 of the Indian Penal Code. Learned counsel for the petitioner submits that the vehicle in question was not recovered from his possession rather it was recovered from one Raju Kumar Choudhary who confessed the involvement of the present petitioner in connection with the present case. It is further submitted that in view of the fact that the confessional statement made before the police is having no evidentiary value and the petitioner may be released.
