2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 341, 323, 307, 504, 506/34 of the Indian Penal Code and sections 27 of the Arms Act.
3. As per allegation in the FIR, informant was a candidate of Mayor election and on 11.12.2022, when she was returning back, ante-social activists entered in her campus and started brick batting as a result of which she sustained head injury. The alleged occurrence was recorded in CCTV footage on which basis, persons were made accused in this case.
4. It is submitted by learned counsel for the petitioner that petitioner is innocent. He was only a member of the mob.
Patna High Court CR. MISC. No.51602 of 2023(2) dt.11-08-2023 2/2 No specific allegation of assault is attributed to him. . AS per injury report, doctor found one abrasion wound in middle of scalp and nature of injury is simple. Petitioner is languishing in judicial custody since 4.4.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM, Patna in connection with Rajeev Nagar PS Case no. 673 of 2022.
