JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 24-11-2015 Heard the learned counsel for the petitioner, the learned A.P.P as also the learned counsel for the Informant. The petitioner seeks bail in a case for the offences punishable under sections 342, 363, 366 (A), 506, 376 and 354 (A) (1)/34 of the I.P.C and section 6 of Protection of Children from sexual Offence Act, 2012.
The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 04.04.2014 vide Cr. Misc. No. 52636 of 2013 on the ground that the trial has not been concluded as yet and the petitioner is suffering in custody since 23.09.2013, to which the learned A.P.P. duly assisted by the learned counsel for the informant opposes by submitting that all the prosecution witnesses have already been examined and the
Patna High Court Cr.Misc. No.35074 of 2015 (4) dt.24-11-2015 2/2 record is fixed for argument and it is likely to be concluded. In the facts and circumstances as stated above, considering the allegation attributed against the petitioner, heinous in nature, this Court is not inclined to reconsider the prayer for bail and accordingly again prayer for bail of the petitioner stands rejected in connection with Sheikhpura Mahila P.S. Case No. 44 of 2013 pending in the court of A.D.J. 1st, Sheikhpura. However, the trial court is directed to conclude the same preferably within one month from the date of receipt/ production of a copy of this order.
