2. The petitioner seeks regular bail in connection with Madanpur P.S. Case No. 10 of 2025 registered for the offence under Sections 103(1), 3(5) of the B.N.S.

3. As per the prosecution case, the petitioner and three others are said to have assaulted the victim, who was a conductor of bus, for dispute over stoppage.

4. Learned Senior counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 14.01.2025.

5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.

6. From the postmortem report, it appears that the deceased had sustained one head injury.

7. Considering the facts and circumstances of the case and the fact that the postmortem report falsifies the F.I.R., this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad/concerned Court below in connection with Madanpur P.S.
