ANJANA MISHRA ORAL ORDER 29-07-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Kalyanpur P.S. Case No.94 of 2018 arising out of G.R. No.1377 of 2018 for allegedly having committed the offence under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case by coaccused Lalit Kumar Sahani on whose confessional statement, the name of the petitioner has surfaced and said Lalit Kumar Sahani has since been extended the privilege of regular bail in Cr.Misc. No.62491 of 2018 and the petitioner is not having any criminal antecedent.

Considering the aforementioned facts and

No. 46932 of 2019(2) dt.29-07-2019 2/2 circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur, in connection with Kalyanpur P.S. Case No.94 of 2018 arising out of G.R. No.1377 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
