JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 18-04-2022 The learned counsel for the petitioners has submitted that the petitioners have filed Title Suit No. 49 of 2018 which is pending in the court of Sub Judge Benipatti. He makes a prayer for a direction for expeditious disposal of the case. The suit was

Patna High Court C.Misc. No.418 of 2021(4) dt.18-04-2022 2/2 admitted on 26.09.2018. The defendants filed their written statement on 11.03.2019. Thereafter the suit was fixed for settlement of the issue, but from perusal of the order-sheet dated 16.02.2022, it appears that a petition under Order VII, Rule 1(a) (d) read with section 155 of the Code of Civil Procedure has been filed by the defendants.

In view of the aforesaid facts, the learned court below is directed to dispose of the said petition within a period of one month from the date fixed in that case.

With these observations, this civil miscellaneous petition stands disposed of.
