Petitioner seeks bail in a case registered for the offences punishable under Sections 364,34 of the Indian Penal Code.

The petitioner is in custody since 28.11.2017 in a case wherein FIR has been lodged against unknown. Submission of the learned counsel for the petitioner is that the charges have already been framed during trial and considering the framing of charge, coaccused Kajla Mahton has been allowed bail by a Coordinate Bench of this Court in Cr.Misc.No.5467 of 2017. Moreover, some other co-accused Mundrika Rai and others have faced trial in Sessions Trial No.249 of 2004 and the trial has resulted in acquittal, as the prosecution did not support the allegation.

No.11019 of 2018 (3) dt.12-04-2018 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No.163 of 2017 arising out of Nayagaon Police Station Case No.34 of 2002, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
