JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 22.9.2017 in Cr.Misc.No. 39812 of 2017 with direction to learned trial court to conclude the trial within a period of six months.
Submission of learned counsel for the petitioner is that six months period has already expired and petitioner is in custody for more than one year and till date no substantive progress has been made in trial. So far criminal antecedent is concerned, it has been submitted that all cases related to old Act and not related to new Act.
Heard learned APP also.
Having heard both sides and in the facts and circumstances of the case, let petitioner, above named, be released
Patna High Court Cr.Misc. No.27149 of 2018 (2) dt.02-05-2018 2/2 on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of 3rd Addittional Sessions Judge-cum-Special Judge, Excise, Muzaffarpur, in connection with Excise Case No. 103 of 2017, arising out of Non F.I.R. (Sadar) P.S.Case No.09/17-18, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and petitioner will co-operate in trial and appear in the court below as and when required, failing which his bail bond shall stand cancelled.
