The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 419, 420/34 of the Indian Penal Code and 66(B), 66(D) of I.T. Act.

The prosecution case in nutshell is that informant received secret informantion that some miscreants were committing forgery and cheating by giving temptation to innocent persons through mobile at the instance of providing loan etc. It is further alleged that sixteen persons were apprehended from the spot,

Patna High Court CR. MISC. No.49018 of 2022(2) dt.15-12-2022 2/3 who disclosed the name of petitioner and other coaccused persons who fled away from the spot. They also disclosed that they were also indulged in the acts of forgery and cheating.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in the present case. It is also submitted that neither the petitioner is apprehended from the spot nor anything incriminating has been recovered from the conscious possession of the petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial
