ANJANA MISHRA ORAL ORDER 27-07-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The learned counsel for the petitioners seeks modification of order dated 30.07.2015 passed in Cr. Misc. No. 5080 of 2015. Learned counsel for the petitioners submits that petitioners No. 2 and 3 have already surrendered in the Court below within the time fixed by the Court and, therefore, no modification is required. So far as these petitioners are concerned, he accordingly seeks liberty to delete their names.
Liberty is granted.
Learned counsel for the petitioner is permitted to delete the names of petitioners No. 2 and 3.
So far as petitioner No. 1 Shatrughan Sharma @ Pintoo,
Patna High Court Cr.Misc. No.24247 of 2016 (3) dt.27-07-2016 P2/2 he submits that due to certain unforeseen circumstances, he could not surrender within time fixed by the Court. He accordingly prays for extension of time by four weeks so that the petitioner may be able to surrender.
Accordingly, let the time fixed for surrender with regard to petitioner No. 1 be extended by a further period of four weeks from today.
It is made clear that if the petitioner (Shatrughan Sharma @ Pintoo) fails to surrender within the said period, the order against him shall stand withdrawn automatically. In view of the aforementioned modification, the application stands disposed of.
