The petitioner apprehends his arrest in Bihta P.S. Case No. 16/16 registered under Sections 414, 120(B) of the Indian Penal Code, Sections 47/48 of the Bihar Excise Act and Sections 2, 3, 4 of Mahua Flour Rules, 2006.
The police apprehended one Pramod Kumar with a vehicle in which Mahua flour was being carried. Pramod Kumar disclosed the name of the petitioner. It is submitted that nothing has been recovered from the possession of the petitioner. The petitioner has been falsely implicated in the case. Considering the fact that save and except the name of the petitioner has come in the disclosure made by the co-accused and there is no evidence against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned
Patna High Court Cr.Misc. No.24778 of 2016 (3) dt.11-08-2016 2/2 court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur in Bihta P.S. Case No. 16/16, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
