JUSTICE SANJAY PRIYA ORAL ORDER 2/ 06-08-2019 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner seeks bail in Saharsa P.S. Case No.165 of 2019 instituted for the offence under Section(s) 307 and other allied sections of Indian Penal Code and Section 27 of the Arms act.

It is alleged in the written report that on the date of occurrence this petitioner along with Aditya Jha @ Chotu Jha, Sunny Jha, Rajkishore Yadav resorted firing on him causing injury below the waist of the informant.

Injury report of the informant has been enclosed as Annexure-3. The doctor has found two injuries, which were grievous. In the written report, the informant has stated that he

Counsel for the petitioner further submits that coaccused, Fantush Jha, has already been granted regular bail by co-ordinate Bench of this Court by order dated 20.05.2019 passed in Cr. Misc. No.33166 of 2019.

Counsel for the informant has opposed the prayer for bail.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Saharsa P.S. Case No.165 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
