Heard the parties in virtual Court.

Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 41 of Bihar Prohibition and Excise Act, 2016.

Recovery of liquor is alleged from a Truck and a Wagon-R Car.

Since the motorcycle of the petitioner was there, the petitioner is under suspicion. Moreover, there is confessional statement of co-accused-Amarjit Mandal @ machchhar Singh wherein name of the petitioner has surfaced. Petitioner has stated on oath that he has got no criminal antecedent. Investigation of the case is already complete.

No.5420 of 2021(2) dt.15-04-2021 2/2 Considering the facts aforesaid, let the petitioner, above named, who is in custody since 23.09.2020, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Baheri Police Station Case No.230 of 2020 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
