2. The petitioner is apprehending arrest in connection with Tatarpur (Vishwa Vidyalaya) P.S. Case No. 181 of 2023 lodged on 20.07.2023, for the offence punishable under Sections 306 & 34 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against two named accused persons including the present petitioner. It has been alleged in the FIR that on the instigation of the petitioner and his sister in law, the brother of the informant committed suicide.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that the name of petitioner has inserted in this case only due to the reason that he is the brother in law of the co-accused namely, Pushpa Kumari to whom bail has been granted by the Co-ordinate Bench of this Court vide order dated 08.01.2024 passed in Cr. Misc. No.83222 of 2023. Counsel submits that it is admitted by the informant itself that his brother had committed suicide and he was in love affair with the co-accused person namely, Pushpa Kumari who has been granted bail. Counsel further submits that the petitioner has no criminal antecedent.
5. Learned APP for the State opposes the prayer for bail of the petitioner but submits that the petitioner is the brother in law of the co-accused person namely, Pushpa Kumari who has been granted bail by the Co-ordinate Bench of this Court.
6. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the B.N.S.S., 2023 to the satisfaction of Additional Chief Judicial Magistrate, Bhagalpur,
