Petitioner apprehends arrest in a case registered for the offence punishable under Sections 420, 467, 468, 379, 504, 427, 506 and 34 of the IPC.

As per the prosecution case, residential house of the informant was sold by the petitioner through registered sale deed in favour of Ashok Dubey and Rakesh Kumar Dubey. Learned counsel appearing for the petitioner submits that the dispute is civil in nature. The petitioner and the informant are full brothers and both partly sold their share in joint properties. In fact, informant has sold his land to the petitioner on Rs. 1,50,000/- and when petitioner came to know that the informant has no land, he(petitioner) demanded his money, but in retaliation, this false case has been lodged against him. Petitioner has got no criminal antecedent. Learned counsel appearing for the State opposes the prayer for bail.

No.48843 of 2022(2) dt.14-12-2022 2/2 Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief judicial magistrate-1, Sasaram, Rohtas in connection with Kochas P.S. Case No. 233 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
