2. The petitioner is in custody in connection with Kanti P.S Case No. 394 of 2024 registered for the offences punishable under Sections 103, 61(2), 238, 3(5) of the BNS.

3. As per allegation in the FIR, petitioner is alleged to have killed the informant's brother in order to grab the property.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that as per the Hindu Law, it is an admitted position that even after the death of the informant's brother, the petitioner is not entitled to get the property left by the deceased as there are legal heirs of the victim also, so the reason for suspicion as

It is further submitted that admittedly, the victims dead body was found lying at the gate of the victim's house but any co-villager or other person belong to the neighboring houses did not come forward to support the said suspicion raised by the informant in the FIR. It is also submitted that petitioner is in judicial custody since 23.05.2025 having clean antecedent. He further submits that other co-accused has been granted bail vide order dated 04.12.2024 in Cr. Misc. No. 83086 of 2024.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

On perusal of the FIR and impugned order dated 24.06.2025, it appears that petitioner name has been figured only on the basis of suspicion raised by the informant and petitioner possess clean antecedent and keeping in consideration that other co-accused persons have been granted bail by the coordinate Bench of this Court vide Cr. Misc. No. 83086 of 2024 and also considering the aforesaid facts and circumstances of the case and submissions made on behalf of the learned counsel for the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of
