JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased. It appears that prior to the institution of the present case a case under section 498A had been lodged against the petitioner but subsequently, the aforesaid case was compromised and deceased again came to her matrimonial home but allegedly, she was killed by the petitioner and her dead body having so many injuries were found.

Considering the nature of allegation as well as facts and circumstances of the case, I am not inclined to grant privilege of bail to the petitioner and accordingly his prayer for bail in connection with, Ghosi P.S.Case No. 193 of 2014, pending in the court of Chief Judicial Magistrate, Jehanabad stands rejected.
