JUSTICE ARUN KUMAR ORAL ORDER 26-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 3.11.2017, seeks bail in Aurangabad Town PS Case No. 220 of 2011 registered under Sections 420, 467, 468, 406 and 120B of the IPC. The allegation in brief is that agents of the company owned by the petitioner received second installment of the premium amount of insurance of Rs. 45,000/- but the same was not deposited by the petitioner.
It is submitted that case of the complainant is that the premium amount was given to another co-accused Arun Sharma, the collecting agent, and not to the petitioner, the petitioner was granted anticipatory bail by order dated 10.11.2016 with the condition to deposit twenty thousand rupees but he could not surrender in view of the direction and now is in custody since 3.11.2017 and also undertakes to deposit twenty thousand rupees. Patna High Court Cr.Misc. No.16581 of 2018 (2) dt.26-03-2018 directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Aurangabad in connection with Aurangabad Town PS Case No. 220 of 2011 subject to the condition that he deposits twenty thousand rupees in the Nazarat of the Civil Court Aurangabad and will produce receipt of deposit of the amount at the time of furnishing bail bonds. The amount so deposited will be kept in safe custody without prejudice to the right and contention of the parties and that will be subject to the final outcome of the case. (Arun Kumar, J.)
