The petitioner being the Rice Mill Owner apprehends his arrest in connection with Madhepura P.S. Case No. 216 of 2015 registered for the offences punishable under Sections 406, 420 of the Indian Penal Code. Learned counsel for the petitioner submits that the FIR has been lodged against him alleging a defalcation of Rs. 97,81,061.00/- as the petitioner being the proprietor of Bhole Nath Rice Mill, Diwari Asthan, Sonbarsa, P.S. Sonbarsa, Saharsa., had not deposited the remaining dues of CMR (Rice) of 4.74,753 quintals. It is further submitted that as per direction issued by this court, he is also willing and ready to deposit 20 percent of the aforesaid amount and he shall do so within a period of 10 months, as the petitioner is lady and is in

Considering the offer made by the petitioner and also the fact that petitioner is ready to deposit the remaining dues within a period of 10 months, let the petitioner above named, in the event of her arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 216 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C. (Anjana Mishra, J) Jagdish/- U T
