JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, one witness at paragraph-30 of the case diary, disclosed that on the alleged date of occurrence, he had seen the petitioner picking clothes and after that, at paragraph-35 of the case diary, one another witness stated that he found the petitioner in suspicious condition on the date of occurrence and except the aforesaid materials, there appears to be nothing against the petitioner who is languishing in jail custody since 30-03-2015.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten

Patna High Court Cr.Misc. No.34848 of 2015 (6) dt.15-12-2015 2/2 thousand) with two sureties of the like amount each in connection with Berari (Semapur) P.S. Case No. 57 of 2015 to the satisfaction of Chief Judicial Magistrate, Katihar.
