Learned counsel for the petitioner is expected to honour his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by the office when called upon to do so by the office.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307, 386, 34 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case as per F.I.R is that in the
Patna High Court CR. MISC. No.6159 of 2021(3) dt.29-01-2022 2/2 background of some dispute with regard to passage, it is alleged that this petitioner and one Jungli Yadav shot fire which hit on the chest of Nityanand Yadav and stomach of Ranhansh Yadav, the informant.
It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the fact that there is direct allegation against the petitioner to shot fire on the injured which fact has also been corroborated with the injury report as mentioned in para 32 and 42 of the case diary, this Court is not inclined to grant anticipatory bail to the petitioner.
The prayer for anticipatory bail of the petitioner stands rejected.
