Petitioner seeks bail in a case registered for the offences punishable under Sections 419, 420, 465, 467 and 471 of the Indian Penal Code.
The informant had advanced Rs.5,66,000/- in cash as well as through RTGS transfer in favour of the petitioner for purchase of land but the land was not transferred for the reason that the petitioner had taken money from different persons on the same pretext of transfer of the same land in their favour. Learned counsel for the informant-opposite party no. 2 is appearing. The petitioner has already refunded Rs.1,88,000/- in the bank account of the informant and the
Patna High Court Cr.Misc. No.63189 of 2017 (7) dt.18-06-2018 2/2 petitioner is ready to refund the remaining amount within six months.
In the circumstances, let the petitioner, above named, be released on provisional bail for six months on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Koilwar Police Station Case No. 237 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner as well as condition that the court below shall confirm the provisional bail only on refund of entire money in the bank account of the informant.
