No doubt, petitioner has criminal antecedent but admittedly, neither petitioner was caught on the spot or anything was recovered from his conscious possession and co-accused Suresh Yadav @ Surendra Yadav @ Bidyarthi @ Bidyarthi Yadav and Subhash Jha @ Suman Jha, who named the petitioner, have already been granted privilege of bail.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri S. K. Rai, Judicial Magistrate, Ist Class, Jhanjharpur District Madhubani/concerned court in Andhramath P.S. Case no. 21/2014.
