JUSTICE ARUN KUMAR ORAL ORDER 16-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 7.3.2017, seeks bail in Hajipur Town PS Case No. 145 of 2017 registered under Sections 302, 394 of the IPC and Section 27 of the Arms Act. It is contended by the learned Counsel for the petitioner that neither the looted scooty was recovered from his possession nor any incriminating material, the petitioner was apprehended on suspicion only on the basis of CDR of his mobile showing presence of the petitioner at the place of occurrence and the petitioner has been in custody since 7.3.2017.
Having considered the said facts and circumstances, the petitioner, namely, Ankit Goswami @ Nirabh Goswami @ Ankit Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Hajipur in connection with Hajipur Town PS Case No. 145 of 2017 with the following conditions:- (i) one of the bailors shall be a close family member of the petitioner; and
Patna High Court Cr.Misc. No.56586 of 2017 (9) dt.16-05-2018 (ii) The petitioner shall appear before the trial court on each date and in case of failure to appear on two consecutive dates except because of reasonable cause his bail bonds shall be liable to be cancelled.
