JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-08-2025 The present petition has been filed for restoration of a petition bearing M.J.C. No. 4099 of 2019, which has stood dismissed for want of prosecution vide order dated 20.06.2025.

The learned counsel for the petitioner has submitted that since the earlier advocate on record appearing in the contempt petition had passed away and the Vakalatnama filed by the

Patna High Court MJC No.2334 of 2025(3) dt.08-08-2025 2/2 present counsel could not be reflected leading to non-depiction of the name of the present counsel in the Daily Cause List, the case could not be attended when the case was called out for hearing, hence, the aforesaid petition was dismissed for want of prosecution, thus a sympathetic view be taken and the aforesaid petition be restored to its original file.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also taking into account the averments made in the present petition, I deem it fit and appropriate to direct for restoration of the aforesaid petition bearing M.J.C. No. 4099 of 2019 to its original file.

The present petition stands allowed.
