According to the prosecution case itself, at the time of alleged occurrence, deceased and the informant along with the petitioner were going on a motorcycle and when they reached near a bridge, other FIR named accused came out and made indiscriminate firings. The informant claimed that petitioner was also in connivance with the aforesaid FIR named accused.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in Bariyarpur P.S. Case no. 118/2011.
