The petitioner seeks bail in Brahampura P.S. Case No.301 of 2017 registered under Section 32 (1) of the Bihar Prohibition and Excise Act, 2016 and Section 272 and 273 of the Indian Penal Code.
As per the prosecution case, 60 liters of toddy is said to have been recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has been falsely implicated in this case. He has no criminal antecedent. The seizure list does not bear the signature of the petitioner. The

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge-cum-Special Judge Excise, Muzaffarpur in connection with Brahampura P.S.
