The petitioner seeks bail in anticipation of his arrest in connection with Magadh University P. S. Case No. 124 of 2020, dated 13.10.2020, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

In view of the recovery of 10 litres of liquor from the house of the petitioner, I am not inclined to grant anticipatory bail to him notwithstanding the fact that he does not have criminal antecedents and the

Patna High Court CR. MISC. No.5064 of 2021(2) dt.10-09-2021 2/2 house in question is in joint possession of others. The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the court below and seeks bail, all these grounds shall be taken into account and an order shall be passed, without being prejudiced by the fact that the present petition on his behalf has not been entertained by this Court.
